By accessing or using the Services, booking a Product, or creating a Hubiter Account, you agree to be bound by these Terms of Use and the Privacy Policy without any modifications. Please note that Hubiter is not a travel or tour agency; we do not supply tours, activities, or experiences. When you book a Product through the Platform, you contract with third-party suppliers, not Hubiter. If you have any questions or concerns, please get in touch with us at the address provided. It is essential to read and understand these Terms of Use as they govern your relationship with Hubiter and the use of the Services, including any Experience (i.e., tour, ticket, attraction, activity, stay, accommodation, or experience) that is advertised on the Website and made available by a third-party supplier. 2. SERVICES

For vehicle hire with a driver, the driver is only responsible for providing transportation, and any additional services offered by the driver are not commissioned or guaranteed by Hubiter. Guided visits and tours of cities and monuments are provided by our partner suppliers and include a professional tourist guide, tickets for preselected monuments, and sponsored events offered by Hubiter. Advance sale tickets are non-refundable. If you need to cancel or seek a refund for services purchased from our partners, please get in touch with them directly. We also offer customizable events like private celebrations and stag/hen parties. These services are as described on our Website, and any modifications may change the previously published price.

3. ACCOUNTS
To use certain features on the Hubiter Website and Services, you may need to create a Hubiter Account and provide personal information. It’s your responsibility to keep your Hubiter Account Credentials, including your password and log-in information, secure and confidential. You’re also responsible for any activities on your account, including Bookings, and should notify Hubiter immediately if you suspect any unauthorized use. Your Hubiter Account is for your personal use only, and you must not impersonate someone else, create an account for anyone else, provide false information, or create multiple accounts. Hubiter reserves the right to terminate or suspend your account and/or access to the Services at any time and for any reason without notice or liability. You may also choose to remove your account anytime by contacting Hubiter. As a user, you understand and agree that neither Hubiter nor its affiliates will be liable for any unauthorized Bookings made using your Hubiter Account Credentials. Additionally, unauthorized use of your account could result in liability to Hubiter and other users, so keeping your account secure is essential. If you choose to close your account, Hubiter may continue to display any User Content you’ve previously published.

4. THE WEBSITE OUTLINE PROHIBITED ACTIVITIES
Our Website and all its content and infrastructure are proprietary to us. You agree not to modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works, transfer, sell, or re-sell any Website content or products/services obtained from the Website without our prior written permission. 6. LIABILITY FOR USER CONTENT
Users can contribute to the Website in different ways, such as by submitting reviews, comments, and photos called “User Content”. We can use your User Content in many ways, such as displaying it on the Website or creating derivative works. By submitting User Content, you agree to give Hubiter and its affiliates the right to use, reproduce, modify, distribute, and publicly display it worldwide for any purpose. If you retain moral rights in the User Content, you agree that you won’t require personally identifying information or claim any entitlement to moral rights. You also agree to release Hubiter from any claims related to moral rights. If there is no License Agreement, you are granted a limited, non-transferable license to use the Software solely for accessing and using the Website in compliance with these Terms of Use. You understand and agree that copyright laws and international treaties protect the Software and that any unauthorized copying, reproduction, or distribution of the Software is strictly prohibited and may result in severe civil and criminal penalties. You are not permitted to copy or reproduce the Software to any other server or location without express permission. The Software is warranted only by the terms of the applicable License Agreement.

The Website and all its content (except for Third Party Content, are the property of Hubiter), including the visual interfaces, custom graphics, design, computer code, Software, compilations of content, and other elements. Hubiter is not responsible for content on websites operated by third parties. All trademarks displayed on the Website, including those of the Products, are registered trademarks of Hubiter, Inc. or its suppliers or licensors and may not be used without written permission. The look and feel of the Website, including page headers, graphics, button icons, and scripts, are the service mark, trademark, and/or trade dress of Hubiter and may not be copied or used without prior written permission. Other trademarks, registered trademarks, product names, and company names mentioned on the Website belong to their respective owners. Reference to any products, services, processes, or other information does not imply endorsement or recommendation by Hubiter. 10. BOOKING AND PRODUCTS
The users must complete the appropriate form in the booking section on the Website and be at least 18 years old, defined in section 2. SERVICES. By Booking, users accept the terms and conditions for using the Website and purchasing the selected services, which includes the obligation to pay for them. Bookings must be made at least 24 hours before the Service begins. Users must provide accurate information and a valid identification document when using the Service. Requests made via fax, email, or telephone will not be considered valid, but users may request specific services via email. Hubiter acts as an agent on behalf of the Supplier and is not responsible for any damages resulting from interactions with suppliers. Users must be at least 18 years old and provide accurate information when making a booking.

11. INCLUSIONS AND EXCLUSIONS IN PRODUCT PRICES
You agree to the quoted price when Booking and provide the necessary invoicing information. The prices on the Website include the VAT and cover only the services and items listed per person unless otherwise mentioned. However, the prices do not include personal insurance, luggage insurance, tourist taxes, personal expenses, tips, charges for additional services not included in the Booking, or compensation for damages caused by the user. Each Product’s price is quoted per person, and the prices are based on the current local tariff and exchange rate as determined by Hubiter. These prices are subject to change until you make a booking. The Supplier determines what is included in the price. Unless the Supplier states otherwise, the prices do not include local taxes or use fees, such as foreign departure, security, port charges, park charges, customs, immigration, agricultural, passenger-facility charges, or international transportation tax. It does not include tips, passport and visa fees, baggage and personal insurance, personal items, taxes or duties, or any beverages or food not explicitly stated as included.

12. Disclaimer on Hubiter’s Currency Converter
Hubiter’s currency converter provides only estimated rates based on public sources, which may need more accuracy. The rates are not verified and may change, and Hubiter and its affiliates are not responsible for any discrepancies.

13. Payment and booking confirmation
When you book a product through Hubiter, you must pay in full using a credit or debit card unless otherwise specified. Hubiter might act as the Supplier’s payment collection agent; the Supplier will be listed as the payee on your statement. Your payment may be subject to additional fees, such as taxes or currency exchange, and your bank or payment card company may charge you additional fees. Payments are processed online through the Stripe payment gateway. Once payment is confirmed, the Booking is considered final, and Hubiter will send an invoice to the email address you provided during the Booking. If payment is unsuccessful, the Booking will not be recorded, and no contractual obligations exist between the parties.

14. Booking Cancellation and Modification Policy
Unless otherwise stated in the Product’s terms and conditions, purchased Bookings cannot be canceled or refunded. However, for cancellations or modifications made up to 24 hours before the scheduled date, refunds will be made as follows: Cancellations made between 30 days before the arrival date to 48 hours before the arrival time will incur a 50% cancellation fee. No refunds will be given for cancellations made less than 48 hours before the scheduled date, including no-shows. Refunds will only be given in the event of a complete service failure by Hubiter. Any delays, partial fulfillment, or later damages caused to the user are non-refundable. Credit card fees and tickets are also non-refundable. Please note that a Supplier may charge a fee to accommodate a Change Request, and Hubiter does not guarantee the success of any Change Request. Any changes made to a Booking using a promotion code or discount may invalidate the discount. Refunds are unavailable for any services that have already been utilized or once the Service has started.

15. Service Withdrawal and Cancellation Policies from Hubiter or Suppliers
Suppliers may change Product features like price, date, or itinerary. Hubiter, acting on behalf of the Supplier, can cancel, change, or substitute any Product you purchased for any reason. If you make a significant change and are unhappy with the alternative offered, you’ll get a full refund. In some cases, we may cancel a Booking and refund part or all of the payment to protect our interests, the Supplier’s interests, or your interests, with no liability to the Supplier or us.

16. Liability Limitations for Hubiter’s Services and Products
Important information: Hubiter is not responsible for any errors or inaccuracies in the information, content, Software, platform, and services provided, including reservation availability and pricing errors. Hubiter reserves the right to correct any errors and/or pricing mistakes. The suppliers are independent contractors, and Hubiter is not responsible for any acts or errors by the suppliers or any resulting damages. Hubiter will not be liable for any direct or indirect damages arising from your use of the services. Hubiter’s liability for any loss or damage related to your use of their services, Booking, or Product is limited to the higher amount of either (a) the sum paid for the Booking in question or (b) one hundred euros (EUR 100.00). The limitations of liability apply even if any limited remedy fails.

17. User Liability and Indemnification
You are responsible for defending and reimbursing Hubiter, as well as its officers, directors, employees, and agents, for any claims, losses, damages, fines, fees, expenses, and any other liabilities arising from your violation of these Terms of Use or referenced documents; your violation of any laws, rules, regulations, or guidelines; any infringement or misappropriation of a third party’s rights, including publicity or privacy; your use of the Services, including the Website; your Booking or use of any Product; or any negligence or intentional wrongdoing by you. This includes reasonable legal and accounting fees.

Jurisdiction and Governing Law
The laws of Italy govern this agreement, and any disputes arising from or relating to the use of this Website will be subject to the exclusive jurisdiction of the court of Rome, Italy, except for disputes governed by consumer law under article 63 of the Italian consumer Code D.Lgs. n. 206/2003. If any provision of these “Terms and Conditions” is deemed invalid, illegal, or inapplicable. In that case, it will be deleted from this agreement while the remaining provisions will remain in full force and effect.
